Participation Agreement - River Programs

 

I hereby agree to provide Trey Moore Inc. with full payment no later than thirty (30) days prior to the program start date. I realize that if I fail to provide full payment by thirty (30) days prior to the start date, Trey Moore Inc. may, at their discretion, cancel my reservation with no refund. (Because pre-trip injuries, illness, and emergencies do occur, Trey Moore Inc. requires that trip participants obtain trip insurance for protection against the loss of non-refundable trip payments.) Furthermore, I can exercise vigorously and I have no known physical or mental condition that would endanger or adversely affect the safety or well-being of myself or any trip participant.

 

There is a 30 day cancellation policy.  Customers will receive a full refund with 30 days notice of cancellation minus your deposit. No Shows and Cancellations made less than 30 days. before the start of your scheduled trip will be charged full ticket price. 

 

Essential Eligibility Criteria for Paddling Programs

Courses are open to all individuals who acknowledge the ability to perform the following essential eligibility criteria.

  1. Breathe independently (i.e., not require medical devices to sustain breathing)

  2. Independently maintain sealed airway passages while under water

  3. Independently hold head upright without neck / head support

  4. Manage personal care independently or with assistance of a companion

  5. Manage personal mobility independently or with a reasonable amount of assistance

  6. Follow instructions and effectively communicate independently or with assistance of a companion

  7. Independently turn from face-down to face-up and remain floating face up while wearing a properly fitted life jacket*

  8. Get in/out or on/off of a paddlecraft independently or with a reasonable amount of assistance*

  9. Independently get out and from under a capsized paddlecraft*

  10. Reenter or remount the paddlecraft following deep water capsize independently or with a reasonable amount of assistance*

  11. Maintain a safe body position while attempting skills, activities and rescues listed in the appropriate Course Outline, and have the ability to recognize and identify to others when such efforts would be unsafe given your personal situation*

* To participate in adaptive programs, participants must acknowledge only the first six EEC listed above. Entry-level adaptive programs will involve teaching and practicing EEC #7-11.


 

 Important Information for Adventure Travel Programs

  • Wilderness travel can be physically demanding. Though prior experience is not required for our trips, good fitness is essential! Depending upon the trip, you will be hiking from four to ten miles on most days over variably rugged terrain. Or you will be paddling for considerable time periods, sometimes into strong head winds.

  • Sustained cardiovascular workouts of power walking, running, hiking, bicycling, etc. are strongly recommended; weight training is also very helpful. Beginning and maintaining a regular conditioning program well before trip departure will greatly enhance your safety and enjoyment!

  • If you haven’t had a recent physical exam or if you have doubts about your health or fitness, we strongly recommend that you see your physician before the trip.


 

Photo/Media Release

I grant Trey Moore Inc., the right to use, reproduce, assign and/or distribute photographs, films, videotapes, and sound recordings of me for use in materials they may create.


 

Assumption of Risk

 

In consideration of being allowed to participate in any way in the program, related events and activities, I the undersigned, acknowledge, appreciate, and agree that:

  • The risk of injury from the activities involved in this program is significant, including the potential for permanent paralysis and death.

  • I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, both known and unknown, EVEN IF ARISING FROM THE NEGLIGENCE OF THE RELEASEES or others, and assume full responsibility for my participation.

  • I willingly agree to comply with terms and conditions for participation. If I observe any unusual significant hazard during my presence or participation, I will remove myself from participation and bring such to the attention of the nearest official immediately.

  • By participating in or attending any activity in connection with this program, whether on or off the premises, I consent to the use of any photographs, pictures, film or videotape taken of me or provided by me for publicity, promotion, television, websites or any other use, and expressly waive any right of privacy, compensation, copyright or other ownership right connected to same.

  • In the event of illness or injury, I hereby give consent for Trey Moore Inc. to provide emergency medical care, evacuation, hospitalization, or other treatment that may become necessary.

  • I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, HEREBY RELEASE, INDEMNIFY, AND HOLD HARMLESS TREY MOORE INC., its officers, officials, agents and/or employees, other participants, sponsors, advertisers, the United States Government, the State of Arkansas and, if applicable, owners and lessors or premises used to conduct the event (RELEASEES), from any and all claims, demands, losses, and liability arising out of or related to any INJURY, DISABILITY OR DEATH I may suffer, or loss or damage to person or property, WHETHER ARISING FROM THE NEGLIGENCE OF THE RELEASEES OR OTHERWISE, to the fullest extent permitted by law.

 

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT FULLY AND UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. I ALSO UNDERSTAND THAT I SHOULD NOT AND MAY NOT PARTICIPATE IN THIS ACTIVITY IF I AM UNDER THE INFLUENCE OF ALCOHOL OR DRUGS.
